These Terms of Service (“Terms”) govern your access to and use of www.treaura.com and any related products, content, features, and services provided by TreAura and its operating entity, usyours llc (“TreAura,” “we,” “us,” or “our”).

By visiting our website, creating an account, submitting content, or purchasing a product, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund & Return Policy. If you do not agree, do not use the Services.

✅ Eligibility and Online Store Terms

You must be at least the age of majority in your jurisdiction, or use the Services with the permission and supervision of a parent or legal guardian. You may not use the Services for an illegal or unauthorized purpose or violate any applicable law while using them.

You are responsible for ensuring that information submitted through the Services is accurate, current, and complete.

🛍️ Products and Product Information

We make reasonable efforts to display product descriptions, dimensions, colors, materials, images, finishes, and availability accurately. However:

• Screen settings and photography can affect color;

• Handmade, plated, painted, antique-finished, or custom products may have minor variations;

• Packaging may change without materially changing the product;

• Measurements and weights may have reasonable manufacturing tolerances; and

• Typographical or technical errors may occasionally occur.

Commemorative coins, challenge coins, medals, tokens, and similar products sold by TreAura are decorative or collectible items and are not legal tender, investment products, or precious-metal bullion unless the product page expressly states otherwise.

We reserve the right to correct errors, update information, limit quantities, discontinue products, or cancel affected orders. If we cancel a paid order, we will refund the applicable amount.

🎨 Custom Products and Customer-Submitted Content

When submitting artwork, photographs, names, text, logos, trademarks, or other content (“Customer Content”), you confirm that:

• You own the Customer Content or have all permissions needed to use and reproduce it;

• Production and use of the Customer Content will not infringe copyright, trademark, publicity, privacy, or other rights;

• The Customer Content is accurate and does not contain unlawful, hateful, defamatory, deceptive, obscene, or otherwise prohibited material; and

• You have obtained any required consent from individuals shown or identified in the Customer Content.

You retain ownership of your Customer Content. You grant TreAura and its production partners a limited, non-exclusive license to use, reproduce, modify, format, transmit, and manufacture the Customer Content solely as reasonably necessary to quote, design, proof, produce, fulfill, support, and document your order.

We may reject or cancel a custom request that we reasonably believe is unlawful, infringes rights, creates safety concerns, violates these Terms, or cannot be produced appropriately. If a request is rejected before work begins, we will refund the applicable payment. Fees for authorized work already completed may be non-refundable to the extent permitted by law.

Proof Approval

When a digital proof is provided, you are responsible for reviewing all text, spelling, dates, layout, dimensions, quantities, colors, and design elements. Your approval authorizes production. TreAura is not responsible for an error present in Customer Content or in a proof that you approved, except where applicable law provides otherwise.

Changes requested after approval may be impossible, may delay the order, and may require an additional fee. Custom products may vary slightly from digital proofs because of materials, scale, plating, relief, enamel, manufacturing tolerances, and screen appearance.

💰 Prices, Payments, and Taxes

Prices, discounts, promotions, shipping charges, and availability may change without notice. The price displayed at checkout when an order is submitted generally controls, subject to correction of obvious errors.

You agree to provide accurate billing and payment information and authorize the selected payment provider to charge all amounts shown at checkout. We may delay, refuse, or cancel an order for suspected fraud, unauthorized payment, pricing error, stock limitations, sanctions or legal restrictions, or violation of these Terms.

Customers are responsible for taxes, duties, customs charges, brokerage fees, and other government or carrier charges unless the checkout page expressly states that they are included.

🎟️ Promotions and Discount Codes

Promotions may have separate eligibility rules, dates, product exclusions, quantity limits, and destination restrictions. Unless stated otherwise:

• Only one discount code may be used per order;

• Discounts cannot be applied retroactively;

• Discounts have no cash value;

• Shipping, gift cards, custom fees, or selected products may be excluded; and

• We may cancel or correct a promotion affected by abuse, fraud, or technical error.

📦 Orders, Processing, and Shipping

Submitting an order is an offer to purchase. An automated confirmation means we received the request; it does not guarantee acceptance. We may contact you for verification or additional information before accepting or fulfilling an order.

Processing and delivery times are estimates, not guarantees. Custom production timelines begin only after required information and approvals are received. Shipping may be affected by carriers, customs, weather, holidays, government action, address problems, and events outside our control.

Customers must provide accurate delivery and customs information and cooperate with reasonable carrier or customs requests. Risk of loss and legal title will transfer as provided by applicable law. Nothing in these Terms limits non-waivable consumer rights.

↩️ Cancellations, Returns, and Refunds

Cancellations, returns, exchanges, and refunds are governed by our Refund & Return Policy. Custom and personalized products may be non-returnable except for qualifying damage, defects, or production errors. We may refuse a return that does not meet the published requirements, subject to applicable law.

™️ Intellectual Property

Unless otherwise stated, the Services and their content—including the TreAura name and logo, website design, text, graphics, product photography, original product designs, videos, icons, and software—are owned by TreAura or used under license and are protected by intellectual-property laws.

You may use the website only for personal, non-commercial shopping purposes. You may not copy, reproduce, scrape, republish, distribute, sell, modify, create derivative works from, or commercially exploit protected content without written permission.

Third-party names, trademarks, artwork, and other rights remain the property of their respective owners. The appearance of a theme or reference does not by itself imply endorsement, sponsorship, or official affiliation.

⭐ Reviews and Other User Content

If you submit a review, comment, photograph, testimonial, or other public-facing content, you grant TreAura a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, translate, display, and distribute that content in connection with our business and marketing, subject to applicable law and our Privacy Policy.

You must not submit content that is false, misleading, unlawful, infringing, harassing, abusive, obscene, malicious, or contains another person's confidential information. We may moderate or remove content at our discretion, but we are not obligated to publish any submission.

You may not:

• Use the Services for unlawful, fraudulent, abusive, or deceptive activity;

• Violate intellectual-property, privacy, publicity, or other rights;

• Upload malware, harmful code, or content designed to disrupt systems;

• Attempt to gain unauthorized access to accounts, networks, or data;

• Scrape, crawl, harvest, or systematically extract website content without permission;

• Circumvent security, rate limits, purchase limits, or access restrictions;

• Impersonate another person or misrepresent your identity or authorization;

• Use payment information without permission;

• Interfere with the website, checkout, customer accounts, or another customer's use; or

• Use our products or Services in a way that violates applicable law.

We may suspend or terminate access, cancel orders, and take other reasonable action in response to suspected violations.

Products are covered only by warranties expressly stated on the product page or required by law. This section does not exclude warranties or consumer guarantees that cannot legally be excluded.

🧭 Limitation of Liability

To the maximum extent permitted by law, TreAura and its officers, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Services or products, including lost profits, lost data, or loss of opportunity.

Where liability cannot be excluded, TreAura's aggregate liability arising from an order will not exceed the amount paid for the product or service giving rise to the claim, except where a different remedy or limit is required by law.

Nothing in these Terms excludes liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or certain personal injury claims.

🛡️ Indemnification

To the extent permitted by law, you agree to indemnify and hold TreAura harmless from third-party claims, losses, and reasonable expenses arising from your unlawful use of the Services, your violation of these Terms, or Customer Content that infringes another person's rights. This obligation does not apply to the extent a claim results from TreAura's own unlawful conduct.

🧩 Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the affected provision will be enforced to the maximum extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.

📄 Entire Agreement

These Terms and the policies referenced in them form the entire agreement between you and TreAura regarding the Services, except for any separate written agreement governing a wholesale or custom project.

⚖️ Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except that mandatory consumer protections in your place of residence may still apply.

Before publishing this section, obtain legal advice regarding the correct governing-law language and whether your business should include jurisdiction, mediation, arbitration, or other dispute-resolution terms.

📝 Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted unless a later date is stated. Your continued use of the Services after an update constitutes acceptance to the extent permitted by law. The version in effect when you place an order will generally govern that transaction.
